The NYSE Regulation Compliance Suite enables NYSE Member Firms to maintain policies, procedures and supervisory controls reasonably designed to assure compliance with the identified rule requirements, and enable pro-active monitoring of trading activity and reporting that may violate NYSE FESC Reporting Requirements.
The data to populate these Reports are derived from the electronic version of the Merged Order Log, which is the daily post - NYSE trade execution data provided by the NYSE following the end of each trading day.
These Reports have been prepared in conjunction with the direction of NYSE Member Firms, and are intended to identify trades and/or conditions that may be considered to be violations of securities laws and/or NYSE Regulations.
Set forth below is a brief description of the nature of each Report:
1. Order and Report Element Retention Report. Presents the Order and Report elements required by NYSE Regulation to be retained by NYSE Member Firms pursuant to NYSE Regulation Information Memo 03-07.
2. MOC LOC Report. Identifies Orders with the Order Type Designation of either MOC (Market on Close) or LOC (Limit on Close).
3. MOC LOC 1539 Report. Identifies Orders with the Order Type Designation of either MOC (Market on Close) or LOC (Limit on Close) entered at or after 15:39 each day.
4. Rule 92 Profile Report - Trading Day. The Rule 92 Report identifies by Symbol all Orders and Execution elements where the firm serves as both Agent and Principal at any point during the trading day.
5. Rule 92 Profile Report. The Rule 92 Report identifies by Symbol all Orders and Execution elements where the firm serves as both Agent and Principal in the same stock at the same time.
6. Large Order Report. Presents large agency and proprietary Orders that may have a significant market impact.
7. FESC Report Cards: These Report Cards highlight specific areas of potential violation of NYSE Rule 123(e) and (f).
a. FESC Daily Report Card. Presents a daily summary of potential violations under each of the following categories: (i) percentage of Executions not linked to a FESC order; (ii) percentage of Orders executed before Order was entered into FESC; (iii) percentage of execution size exceeding the size of the Order entered into FESC; (iv) percentage of Orders-Executions with an invalid Account Type; and (v) Order-Executions with missing data details.
b. FESC Report Card - Missing Order Details. Identifies trades submitted to FESC with missing or invalid order details.
c. FESC Report Card - Missing Account Type Report. Identifies trades with missing or invalid Account Type designation.
d. FESC Report Card - Executions Not Linked to Orders Report. Presents Executions not linked to an Order.
e. FESC Report Card - Executions Prior to Order Report. Presents Executions that occur prior to the Order being entered into FESC.
f. FESC Report Card - Executions Exceed Order. Presents Execution totals that exceed the Order size.
